are the terms of use for MiKnow, the online platform designed for blended
learning (after this course environment, website) of Nijssen Adviesbureau voor
Informatica B.V., known under the trade names PNA and PNA GROUP, and the
subsidiaries of Nijssen Adviesbureau voor Informatica B.V., being PNA B.V., PNA
Products B.V., PNA ActiveMedia B.V. and PNA Ventures B.V. (jointly ‘PNA’, ‘PNA
Group’, ‘we, ‘us’).
LearnWorlds has its own Terms of Service (see https://www.learnworlds.com/terms/) that also partly hold for the End User (the user of the course environment being you, the PNA customer). For these terms of use, the following points from the Terms of Service of LearnWorlds as known at the version date (see 6) are particularly important (but not exhaustive) for you. You are expected to have gained knowledge on at least the following points:

The
terms of use form a legally binding agreement between you and us and contain
the rules and conditions for the use of this website. The goal is to make it
clear to you what your rights and obligations are when using the website and to
ensure a safe and fair digital environment for everyone. If you do not agree
with these terms of use, you must refrain from visiting and using the website.
The
website is built with the help of the cloud application of LearnWorlds, a
Software as a Service (SaaS) provider. We are responsible for the structure and
content of the website. LearnWorlds provides the functionality of the cloud
application and the hosting of the website. This means that we use the services
of LearnWorlds as they are offered to us ("as-is"), in which
LearnWorlds is responsible for the management and the availability of the cloud
application and with that of the website.
LearnWorlds has its own Terms of Service (see https://www.learnworlds.com/terms/) that also partly hold for the End User (the user of the course environment being you, the PNA customer). 1. Access and use
- You may only use the website for legitimate and legal purposes.
- If you provide information, you agree to not generate or spread content that is unlawful, harmful, threatening, offensive, defamatory, obscene, discriminating, or otherwise objectionable.
- You only make an account if you are authorized to do so. For example, because the website invites you to follow a free demo or a subject for which you need to log in first, because you bought a course or license for which login is applicable, because PNA authorized you, or because PNA has an agreement with your organization that is applicable to the relevant login. For organizations it holds that you must be authorized though the authorization procedure that holds in the organization to make an account and to be allowed to use the corresponding login.
- You are responsible for all the activities that take place under your account.
- You make your account with non-fictional valid information.
- You make at most one (1) account.
- You are not allowed to transfer, lend, lease or otherwise provide your account to others in any form.
- The website is developed with a specific purpose. You agree to not use the website for other purposes.
- You are responsible for all input you submit to the website as well as any associated output. By submitting input to the website, you represent and guarantee that you have all rights, licenses and permissions that you need to process this input. You also represent and warrant that your submission of the input to the website and any associated output will not infringe the terms of use any applicable laws and regulations, particularly the Algemene verordening gegevensbecherming (Dutch implementation of the GDPR).
- You use a stable internet connection and a current, secure browser with automatic updates.
- By using the website, you represent: that you read and understand these terms of use and to agree to these terms of use and to be bound by these terms of use.
2. Monitoring
- The use of the website is monitored for security reasons, to provide you with better service, mainly concerning the blended learning aspect (interactive guidance by a consultant and direct feedback) and to be able to improve the website. Consult the privacy statement (see 5) for more information.
- If your use of the website is not in line with the terms of use, appropriate measures will be taken depending on the severity.
- Not that, in line with the LearnWorlds Terms of Service (on the version date (see 6) specifically point 18.2 and 18.4), LearnWorlds can monitor you for their own purposes and delete your data at its own discretion without permission or knowledge of PNA. We want to emphasize that PNA is in no way responsible or liable for this monitoring and data deletion, the way in which LearnWorlds may process personal data while doing this, or any consequences. This is outside of our sphere of influence and is entirely under the responsibility of LearnWorlds and their policy. 3. Intellectual property rights
- All intellectual property rights relating to the website belong to PNA or its licensors.
- You do not receive property rights through use of the website. It is not permitted to copy, distribute, change, or use the material of the website for commercial purposes without prior permission.
4. Limitation of liability
- Except as required by law, PNA is not liable for any direct, indirect, incidental, special or consequential damages arising from the use of (parts of) the website. This exclusion of liability holds regardless of whether the damages arises from breach of contract, tort or any other legal grounds.
- PNA does not guarantee that the website is free of errors, defects or interruptions. Use of the website is completely at your own risk. We make no warranties regarding availability, functionality or the accuracy of information.
- PNA endeavors to provide the information, services and functionalities with the upmost care. We are solely responsible and liable for information, services and functionalities which are directly developed, managed, or provided within our sphere of influence. We cannot accept liability for elements coming from third parties, including LearnWorlds, over which we have no direct control. We advise you to consult the terms of use of the third party when in doubt.

6. Changes
These terms of use
can be changed by PNA without prior notice. If the conditions for use of this
website change, for example because of new or changed functionality or laws and
regulations, then we will adapt the terms of use accordingly if needed. Therefore,

7. Applicable law
No single party has
the right to claim liability, compensation, monetary amounts or other claims,
whether or not through a judge, from PNA based on the activities, events or
circumstances that are beyond the reasonable control or influence of PNA. PNA
expressly excludes every form of liability that results from or relates to such
activities, events or circumstances.
With disputes, conflicts or differences in interpretation of translated text concerning that which is inside out sphere of influence, the present terms of use, our privacy statement, our cookie statement or, in the case where these do not provide a definite answer, our view prevails.
These terms of use are ruled by and interpreted in accordance with the Dutch law. All disputes that arise from or relate to these terms of use are submitted exclusively to a competent judge in the district Limburg, location Maastricht.
