This is the privacy statement of Nijssen Adviesbureau voor Informatica B.V., known under the trade names PNA and PNA GROUP, and the subsidiaries of Nijssen Adviesbureau voor Informatica B.V., being PNA B.V., PNA Products B.V., PNA ActiveMedia B.V. and PNA Ventures B.V. (jointly ‘PNA’, ‘PNA Group’, ‘we, ‘us’) solely applicable in the specific context of our collaboration with LearnWorlds, our SaaS-provider for the development and offering of courses.

Within this context personal data is processed. We want to clearly and transparently inform you about this processing with this privacy statement. Read through this information carefully so you understand why and how we and LearnWorlds process personal data and what your rights are regarding the processing in this specific context.

We use certain words in this privacy statement. Below you will read what we mean by some of these words:
  • Personal data: data that directly or indirectly says something about you. For example, your name, address and place of residence, but also your phone number and email address.
  • To process: everything that can be done with personal data. For example, the collection, but also the storage, use, and deletion of your personal data.

1. About PNA and LearnWorlds

PNA, expert in the field of knowledge management, helps organizations with knowledge intensive challenges and lays the foundation for sustainable and intelligent use of knowledge. We gladly share our expertise through high-quality courses around our approach and knowledge standards. For more information go to the PNA company website: https://pna-group.com/en/.

LearnWorlds is an independent SaaS-provider that supplies the cloud application and hosting services through which we are able to offer our courses in the form of the MiKnow course environment. For more information go to the LearnWorlds website: https://www.learnWorlds.com/.

2. What is SaaS

SaaS mean “Software-as-a-Service”. It is a way to use software through the internet (the cloud application) without the need for you or us to install or maintain it. In this case it is the cloud application of LearnWorlds through which PNA made the MiKnow course environment. This course environment is also hosted by LearnWorlds and is available to be used by you though the MiKnow website present there: https://pna.miknow.nl/signin.

3. Mutual relationship between PNA, LearnWorlds, you

MiKnow, our online course platform for blended learning (integrated combination of physical (face-to-face) and digital (online) learning activities, learning materials and tools), is realized in a cloud application of the type LMS (Learning Management System) that is purchased by PNA SaaS through an agreement with SaaS-provider LearnWorlds. PNA is only allowed to use this cloud application when the conditions that LearnWorlds imposes in their Terms of Service are met (see https://www.learnWorlds.com/terms/).

In order to be allowed to use MiKnow you have to be a customer of PNA and you have to adhere to what PNA has determined in our terms of use (see https://pna.miknow.nl/terms). You will have to share personal data like your name and contact information, in part to pair you with a course, monitor your progress and answer your questions.

Since a SaaS is being used, everything you do with MiKnow will be processed and stored on equipment of LearnWorlds. Hence, when you use MiKnow, you are a user of the equipment and of the cloud application of LearnWorlds. LearnWorlds sets conditions to their users that are determined in their Terms of Service (see https://www.learnWorlds.com/terms/). Consequently, the Terms of Service of LearnWorlds contain conditions for us but also for you as a user. Only when you adhere to these can you use MiKnow (or another course environment within LearnWorlds).

In their Terms of Service LearnWorlds states that there are three parties: The School Owner (the owner of the course environment (=School), in this case PNA), the End User (the user of the course environment, you, the customer of PNA) and LearnWorlds itself (the SaaS-provider that provides the cloud application and hosting services for the creation, maintenance and hosting of Schools).

From the preceding it is clear that in the Terms of Service of LearnWorlds both the owner of the course environment (PNA) and you (the user) are subject to conditions that must be fulfilled. Therefore, it pays to recommend reading the full actual Terms of Service of LearnWorlds and all documents mentioned in it.

For this privacy statement, the following points from the Terms of Service of LearnWorlds as known at the version date (See point 6) are particularly important (but not exhaustive) for you. You are expected to have gained knowledge on at least the following points:

4. Who is responsible for the processing of my personal data in this context?

Based on the Terms of Service of LearnWorlds (on the version date (see point 6) point 23.1 specifically) PNA is the one responsible for processing (controller) and LearnWorlds de processor of personal data (processor). The controller is the organisation that decides what the personal data is used for and how it is used. The processor is the organisation that processes the personal data for the controller. The controller is the one ultimately responsible for the personal data. The processor executes tasks at the behest of the controller and has to adhere to the agreements (among others captured in the processing agreement).

The term controller and its interaction with the term processor play an important role in this context as they are used to determine who is responsible for the compliance with the different data protection rules and how you can exercise your rights. According to the guidelines by the Autoriteit Persoonsgegevens (the authority on personal data in the Netherlands), the controller must decide on both the goal and the means of the processing (source: 'Autoriteit Persoonsgegevens: begrippen verwerkingsverantwoordelijke en verwerker'). PNA makes use of the services of LearnWorlds as they are offered (“as-is”) and does not have a say on the hosting policy (think about management and availability), the architecture/used techniques of the hosting (recourses) and the functionality of the cloud application (for example to make an account) of LearnWorlds. PNA solely determines the structure and content of the course environment and with that has limited ability to determine what personal data that is requested by the functionality is used or not. Therefore, LearnWorlds is (also) controller in many situations.

In the mentioned source it is recorded that the legal status of a party as controller or processor in principle must be determined by their actual activities in a specific situation and not by a formal designation of a party as the controller or processor (for example in a agreement like the Terms of Service of LearnWorlds).

Why is all this relevant to you? The controller is your first point of contact surrounding the processing of your personal data. If you are a customer of PNA, then PNA will act as your controller for your personal data. Where appropriate PNA will, in line with the previous paragraph, determine if PNA is the controller and act accordingly. If PNA is not the controller than we will relay your communication, request, question or complaint to the controller, inform you about this and guide the handling.

PNA is not liable for any activity of LearnWorlds, including the processing and storage of (personal) data with related hosting services by LearnWorlds, that is outside our sphere of influence.

5. What you should at least know

PNA will, as recorded in point 4, act as controller for your personal data in this context. In the privacy statement of PNA you can read what rights you have surrounding the processing of your personal data, how you can exercise these rights and where you can go with a communication, request, question or complaint. Furthermore, there you can read what personal data PNA processes and how PNA deals with this. You can always find the most recent version of our privacy statement through:

By using the MiKnow website you agree with the by PNA determined terms of use that also relate to the processing of your personal data. Therefore, you are expected to have gained knowledge of this and understand it. The most recent version of the terms of use can always be found through:

As determined in point 3, LearnWorlds has Terms of Service that you agree to on all points and referenced documents that relate to the End User (the user of the course environment, being you, the customer of PNA) by making use of the MiKnow course environment.  The Terms of Service also relate to the processing of your personal data. You are expected to have gained knowledge on these and understand them, where the points mentioned in point 3 can function as a guideline. LearnWorlds is located in the United States. When personal data is passed to countries outside of the European Economic Area (EEA), like the United States, there are additional rules in effect (for more information see 'Personal data transfers outside the EEA').

LearnWorlds participates in the EU-US Privacy Framework and with that falls under the adequacy decision. In addition, PNA has determined that LearnWorlds has implemented different measures that make sure that personal data is processed in accordance with the Algemene Verordening Gegevensbescherming (AVG, the Dutch version of the GDPR) on their platform. For more information see the Terms of Service of LearnWorlds (link provided above, on the version date (dee point 6) point 22 specifically). Furthermore, PNA has entered into a processing agreement with LearnWorlds (Data Processing Agreement, included in the Terms of Service of LearnWorlds through the reference: https://www.learnWorlds.com/dpa/). The processing agreement ensures that LearnWorlds adheres to the prescribed (legal) rules when processing your personal data.

6. Can PNA change this document?

This privacy statement can be changed by PNA without prior notice. If the processing of personal data by PNA changes, for example because of changed laws and regulations, then we will adapt the privacy statement accordingly if needed. Therefore, it is recommended to regularly consult the privacy statement.

Changes come into effect from the moment they are published there. This privacy statement was changes last on 04 August 2025.

7. Applicable law

No single party has the right to claim liability, compensation, monetary amounts or other claims, whether or not through a judge, from PNA based on the activities, events or circumstances that are beyond the reasonable control or influence of PNA. PNA expressly excludes every form of liability that results from or relates to such activities, events or circumstances.

With disputes, conflicts or differences in interpretation of translated text concerning that which is inside out sphere of influence, the present privacy statement, our terms of use, our cookie statement or, in the case where these do not provide a definite answer, our view prevails.

This privacy statement is ruled by and interpreted in accordance with the Dutch law. All disputes that arise from or relate to this privacy statement are submitted exclusively to a competent judge in the district Limburg, location Maastricht.
